BMG and Wal-Mart Sued Over Evanescence Lyrics

WAL-MART SUED FOR OFFENSIVE EVANESCENCE LYRICSUS supermarket giant WAL-MART is being sued after selling an EVANESCENCE album containing swear words. Parent TREVIN SKEENS bought the ANYWHERE BUT HOME album for his 13-year-old daughter and was disgusted when he heard the explicit lyrics.He says, "I don't want any other families to get this, expecting it to be clean. It needs to be removed from the shelves to prevent other children from hearing it." The lawsuit accuses Wal-Mart of deceiving its customers by not putting warning labels on the cover and seeks damages of up to $74,500 (£38,660) for everyone who bought the album at the Maryland superstore.Wal-Mart - which has a policy of not stocking CDs which carry parental advisory labels - is investigating the claims but has no immediate plans to pull the CD.Spokesman GUY WHITCOMB says, "While Wal-Mart sets high standards, it would not be possible to eliminate every image, word or topic that an individual might find objectionable."

EVANESCENCE's record label WIND-UP RECORDS and distributor BMG ENTERTAINMENT have also been named in the legal action.
