Gabriel Aubry will not be charged for allegedly pushing his daughter Nahla's nanny.
The model was said to have shoved Alliance Kamden - who has since quit her job - while she was holding his three-year-old daughter last month, but according to the Los Angeles County Court there was "insufficient evidence" to charge him.
Gabriel and ex-partner Halle Berry, Nahla's mother, have been involved in an on-going dispute about the care of their daughter, and earlier this month he was stopped from having unsupervised visits with her.
A source said: "Case workers are recommending that a nanny be present with Gabriel during his visitation times. Halle's nanny had been with Nahla when Gabriel had his custodial time from noon until she went to sleep.
"However, after the alleged incident between the nanny and Gabriel, that hasn't been in place, and he has been alone with Nahla. It will be up to the judge to implement the recommendations."
Halle is now thought to want to move to France with her boyfriend Olivier Martinez with her daughter because she is scared "for her life" due to stalker Robert Hoskins.
