The future of wrestler Chris Benoit's multi-million dollar estate will be determined by a court, which has to decide in which order the star killed his wife and young son. Neither Benoit or his wife Nancy left wills, and as a result the order of the deaths could affect whether the WWE star's mother-in-law Maureen Toffoloni, or Benoit's children from a previous marriage is entitled to any of his fortune - which includes two homes and other assets worth millions. It is believed Benoit strangled his wife with a cord before using a choke hold on his six-year-old son Daniel, placing bibles by their bodies and then hanging himself. But if Daniel died first, under Georgia State Law, some of the estate would pass to Toffoloni - and Toffoloni's attorney is asking the Fayette County court to determine the true order based on law and "not what we hear on TV".The three were found dead at the Benoit home in Fayetteville, Georgia on 25 June (07).Nancy filed for divorce from Benoit in 2003 citing that their marriage was 'irrevocably broken' as well as alleging 'cruel treatment' she later dropped the suit.Benoit was one of the most popular wrestlers and was World Heavyweight Champion in both WCW and WWE.
