Samantha Geimer is set to ask the judge to spare Roman Polanski from further time behind bars.
According to the Associated Press, Samantha Geimer's lawyer is planning to file a motion on Thursday (21Jan10) requesting the Chinatown filmmaker be handed his sentence in absentia.
And the attorney is also reportedly backing Polanski's lawyer's request that he be sentenced to time served and freed.
Polanski pleaded guilty to raping Geimer when she was a 13 year old but fled to Europe in 1978 before he could be handed his punishment.
He remained a fugitive until he was arrested in Switzerland last year (09).
A judge will rule on Friday (22Jan10) whether or not Polanski, who is currently under house arrest in Switzerland, can be sentenced in absentia.
