Tracy Morgan is suing Wal-Mart as he believes the company is responsible for the crash which left him in a critical condition in hospital in New Jersey last month.

The former '30 Rock' star, who sustained a number of injuries, including a broken femur, broken nose and broken ribs, when a Walmart truck crashed into the limo bus he was travelling in on the New Jersey Turnpike last month, filed a lawsuit against the US retail giant on Thursday (10.07.14), claiming the company is responsible because the truck driver Kevin Roper was allegedly fatigued when the accident occurred and that "Walmart knew or should have known" that he had been "awake for more than 24 consecutive hours."

Court documents, obtained by The Hollywood Reporter, state: "Wal-Mart was careless and negligent in the ownership and operation of its motor vehicle, which caused Mr. Morgan to suffer severe personal injuries.

"As a direct and proximate result of said collision, Mr. Morgan was caused to sustain severe painful bodily injuries, including but not limited to multiple fractures which required multiple surgeries, extensive medical treatment and will require significant physical rehabilitation."

Wal-Mart issued a statement saying it is "committed to doing the right thing for all involved."

The 45-year-old actor, who spent 10 days in a critical condition in hospital, was transferred to a rehab facility on June 20, but still "has a long way to go" before he fully recovers from the six-vehicle accident, which also killed his comedy writer friend James McNair.

Tracy's assistant, Jeffrey Millea, his wife Krista Millea and comedian Ardie Fuqua are also suing for negligence, and Krista is suing for loss of consortium.

The group are seeking compensatory and statutory damages, punitive damages, legal fees, as well as pre- and post judgment interest at a trial by jury.
