Shia LaBeouf's uncle has filed an appeal against an order to repay the actor for an $800,000 loan.

Barry Saide was ordered to give back the full amount, plus nine percent interest, in a court case last month after the judge heard he and his famous nephew initially agreed the money, which was handed over in 2009, would be returned in 15 installments of $53,333.

Barry is now asking the judge to reconsider the ruling and wants to pay back in an alternative to money.

Documents filed on Wednesday and obtained by RadarOnline.com state: "The alleged Promissory Installment Note is not an unconditional promise to pay which may form the basis for a motion for summary judgement in lieu of complaint... By its terms, the alleged Promissory Installment Note provides specifically that there I an alternative to the payment of money only."

Barry claims the judge made an incorrect ruling because he didn't pay attention to a part of his original agreement with the 'Nymphomaniac' star which stated he could repay the loan with personal property, and pointed to his original argument in which he stated he transferred interest in four companies in lieu of cash.

No ruling has been made yet on the appeal.

When the lawsuit was filed last August, Barry expressed surprise about the 27 year old actor's actions insisting he wouldn't have borrowed anything if he thought this would happen.

In an affidavit, he reportedly said: "Had I thought that Shayne and Shia would take this extraordinary step and seek to impoverish me, I never would have borrowed a dollar from Shia."

Barry also insisted he spent money looking after the Hollywood hunk and his mother Shayne before his rise to stardom.
